These terms are an agreement between you and the developer of Forage (“we”, “us”) for your use of the Forage app and this website. By downloading or using Forage you agree to them. If you don't agree, please don't use the app. We have tried to keep them plain. Please read the safety section in full.
Foraging safety disclaimer
Forage does not identify plants, fungi or any other species, and never tells you that anything is edible, safe, or ready to eat.
- Forage is a notebook for places you already know. What a spot is called, and what you think grows there, comes from you.
- “Probably ready”, spot conditions, seasons, map overlays and the assistant are rough estimates from weather, dates and your own notes. They are not identification, and they can be wrong.
- You alone are responsible for identifying anything you pick and for deciding whether to eat, use, sell or give it to anyone. Many wild species are toxic, some are deadly, and some have dangerous look-alikes.
- Learn from qualified local experts, field guides and mycological or botanical societies. Never eat anything you can't identify with certainty. When in doubt, leave it.
- Outdoor activity carries risk: terrain, weather, wildlife, getting lost, and losing signal or battery. Plan ahead and don't rely on the app as your only means of navigation.
To the fullest extent the law allows, we are not liable for any illness, injury, death, loss or damage arising from foraging, from consuming or using anything you collect, or from relying on anything shown in the app.
1. The app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Forage on devices you own or control, for your own use and, if you use Pro, your own foraging business. You may not copy, resell, reverse engineer or redistribute the app except as the law allows. We may update, change or stop offering features, and will try to give reasonable notice of significant changes.
2. Acceptable use
You agree to forage lawfully and responsibly. In particular:
- Respect land access laws. Don't enter private property without the owner's permission.
- Follow the rules of the land you are on, including park, forest and refuge regulations, closures and harvest limits.
- Get any permits you need, and carry them. Permit tracking in Pro is a reminder tool; it doesn't grant permission or tell you which permits are required.
- Don't harvest protected, endangered or listed species.
- Harvest sustainably and leave places as you found them.
Map overlays such as public land boundaries are general reference data. They can be out of date or inexact, and they are not legal proof of where you may go or what you may collect. Check with the land manager.
3. Your content
Your spots, notes, photos, visits and records belong to you. They are stored on your device, not with us (see the Privacy Policy). Because we don't hold a copy, you are responsible for keeping backups, for example with GeoJSON export or your device's backup. Photos are not included in GeoJSON exports. We can't recover data that is lost when a device is lost, reset or the app is deleted.
4. Subscriptions and purchases
Forage is free to use. Optional paid features are available:
- Premium, as a yearly subscription or a one-time lifetime purchase.
- Pro, as a yearly subscription, which includes Premium.
Prices are shown in the app before you buy and may vary by country and change over time.
Billing and renewal
- Purchases are made through, and charged to, your Apple App Store or Google Play account.
- Subscriptions renew automatically each year at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- If a free trial or introductory offer is offered, its terms are shown before you buy. Any unused part of a free trial ends when you buy a subscription, where the store applies that rule.
Managing and cancelling
You can manage or cancel a subscription in your account settings: on iPhone, in Settings > your name > Subscriptions; on Android, in the Google Play app under Payments & subscriptions. Deleting the app does not cancel a subscription. After you cancel, paid features stay available until the end of the period you have paid for.
Lifetime purchase
Premium lifetime is a one-time purchase that does not renew. It unlocks Premium for as long as we offer the app on your platform, on devices signed in to the same store account.
Refunds
Refunds are handled by Apple or Google under their policies; we can't issue them directly. Request one from Apple at reportaproblem.apple.com, or from Google through Google Play.
Restoring
If you reinstall or change devices, use Restore purchases in the app while signed in to the same store account.
5. Maps and third-party data
Forage shows maps and data from third parties, including OpenStreetMap contributors via OpenFreeMap, USGS The National Map, the Bureau of Land Management, the USDA Forest Service and Open-Meteo. These are provided by others under their own licences and terms, may be unavailable, and may be inaccurate or out of date. Land and habitat overlays cover the United States only. Attributions are listed at the foot of every page on this site and in the app.
6. Apple users
If you got Forage from the Apple App Store, Apple's Licensed Application End User License Agreement (Standard EULA) applies in addition to these terms. If they conflict, the Standard EULA governs to the extent required. In addition:
- These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
- Apple is not responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property claims.
- You confirm you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
7. Google Play users
If you got Forage from Google Play, the Google Play Terms of Service that apply to your account also apply to your purchases. Google is not responsible for the app.
8. No warranty
Forage is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including that the app will be error-free or uninterrupted, or that any map, overlay, weather data, estimate or assistant answer is accurate or complete.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the app or of anything you forage. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim. Some places don't allow certain limits on liability, so some of these may not apply to you. Nothing in these terms limits rights you have under consumer protection law that can't be waived.
You agree to indemnify us against claims arising from your breach of these terms or of any law while foraging.
10. General
We may update these terms. When we do, we'll change the effective date above, and the new terms apply to use after that date. If any part of these terms is found unenforceable, the rest still applies. Not enforcing a term is not a waiver of it.
